DMCA & Copyright Policy

SMARTCHAINE AI respects the intellectual property rights of others and expects users to do the same. We take copyright infringement seriously and will respond promptly to valid notices submitted in accordance with the Digital Millennium Copyright Act (DMCA) and applicable international copyright law.

Images generated by SMARTCHAINE AI are produced by AI models based on user-supplied text prompts. Key points:

• Users are responsible for ensuring their prompts do not intentionally reproduce copyrighted works.
• SMARTCHAINE AI does not intentionally train models on copyrighted material without license.
• Generated images are owned by the user who created them, subject to these Terms.

If you believe content hosted or generated through SMARTCHAINE AI infringes your copyright, please send a notice to our designated agent containing all of the following:

1. Your physical or electronic signature.
2. Identification of the copyrighted work you claim has been infringed.
3. Identification of the infringing material (including the specific URL or generation ID).
4. Your contact information (name, address, phone number, and email).
5. A statement that you have a good faith belief the use is not authorized by the copyright owner.
6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

If you believe content was removed in error, you may submit a counter-notification containing:

1. Your electronic or physical signature.
2. Identification of the content that was removed and where it appeared before removal.
3. A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification.
4. Your name, address, and phone number, and a statement consenting to the jurisdiction of the federal court in your district (or, if outside the US, any judicial district in which SMARTCHAINE AI may be found).

Upon receipt of a valid counter-notification, we may restore the content within 10–14 business days unless the original complainant files a court action.

SMARTCHAINE AI will terminate accounts of users who are found to be repeat infringers, in appropriate circumstances and at our discretion, in compliance with the DMCA's safe harbor provisions.
