Terms of Service

By accessing or using SMARTCHAINE AI (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We reserve the right to update these terms at any time; continued use after changes constitutes acceptance.

SMARTCHAINE AI provides AI-powered image creation tools including Image Generator, Thumbnail Creator, Background Remover, and Image Upscaler. The Service operates on a credit-based model — you purchase credits and use them to generate content. Credits are non-transferable and linked to your account.

You must create an account to use paid features. You agree to:

• Provide accurate, complete registration information.
• Maintain the security of your account credentials.
• Promptly notify us of any unauthorized access.
• Be at least 13 years old (or the minimum age in your jurisdiction).

You are responsible for all activity that occurs under your account.

Credits are the currency used to generate content on the platform. Key rules:

• Credits purchased do not expire and are not time-limited.
• Credits are non-refundable once they have been used to generate content.
• Unused credits may be refunded within 7 days of purchase — contact support to request.
• We reserve the right to adjust pricing for future purchases; existing credits are not affected.
• All prices are in USD unless stated otherwise.

You may not use SMARTCHAINE AI to:

• Generate content that is illegal, defamatory, obscene, or violates the rights of others.
• Create non-consensual intimate imagery (NCII) or content depicting minors in a sexual context.
• Generate content that promotes violence, terrorism, or hate based on protected characteristics.
• Attempt to reverse-engineer, scrape, or abuse our API or infrastructure.
• Create misleading deepfakes intended to deceive or defraud individuals.
• Violate any applicable local, national, or international law.

We may suspend or terminate accounts that violate these rules without refund.

You retain full ownership of the images you generate using SMARTCHAINE AI. You grant us a limited, non-exclusive license to store and serve your content for the purpose of operating the Service.

We do not claim ownership of your generated images, and we will not use your content to train AI models without your explicit consent.

The SMARTCHAINE AI platform, interface, and underlying technology are owned by us and protected by intellectual property law.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any specific output quality will be achieved. AI-generated content is inherently variable.

To the maximum extent permitted by law, SMARTCHAINE AI and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of or inability to use the Service. Our total liability to you for any claim shall not exceed the amount you paid in the 3 months preceding the claim.

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Paris, France, unless otherwise required by applicable consumer protection law in your jurisdiction.
